I want to build a deck. Do I need a permit?
Maybe, you might need a few!
1. Decks that are level or below 36 inches at any point with no roof do not need a building permit; over the 36 inch mark at any point and/or include a roof, will need a building permit. For a building permit, follow the guidelines above for Residential and Commercial properties.
2. You may need a Stormwater Management permit; contact the Borough to verify. This is an ordinance that was passed by all Westmoreland County municipalities and applies to both residential and commercial properties. An application can be submitted to the Borough and it will be forwarded to our Engineer. Click on the buttons below to view the Ordinance, the fee schedule and to print out an application.
3. Verify if your property is located in the Floodplain. You can check the status of your property by visiting https://msc.fema.gov/portal/home. If you are in the special flood hazard areas (SFHAs) - the blue highlighted area on the map, you will need a Floodplain permit that will be issued by our Floodplain Administrator. I want to build and addition, attached garage, etc. Do I need a permit?
Yes you need more than one!
1. You will need a building permit. Building permits are a state requirement in Pennsylvania, regulated by the Pennsylvania Uniform Construction Code (UCC), which is part of PA Act 45 of 1999. Smithton Borough does not issue building permits.

Yes!
These permits are regulated by the Pennsylvania Uniform Construction Code (UCC); Smithton Borough does not issue these permits.
I want to cut a tree down on my property. Do I need a permit?
Maybe....
If the tree is between the sidewalk and the street, these are Borough owned shade trees that you are responsible for. The cost to obtain a permit is $100.00. A "Shade Tree Permit" will need to be submitted and approved before it is cut. The tree will need to be replaced by Borough guidelines. If the tree is located else where on your property, nothing is required.

1. Structures that are under 1000 sq. feet, and not attached to anything (like a house) and is non livable; does not require a BUILDING PERMIT.
